A U.S. federal appeals court will hear oral arguments from the government on Dec. 14 seeking to reverse a preliminary injunction that halted a ban of ByteDance’s short-form video app TikTok from Google and Apple’s app stores. The arguments will be heard by a panel consisting of Judges Judith Rogers, Patricia Millett, and Robert Wilkins.
At the heart of the appeal is a Sept. 27 ruling by D.C. District Court Judge Carl Nichols, which granted the app a reprieve from a Commerce Department order issuing a ban of the app on the grounds of it being a national security risk.
On Nov. 27, the Committee on Foreign Investment in the United States (CFIUS) gave ByteDance an additional seven days on its deadline (shifting it to Friday) to sell off the U.S. operations of the short-form video app, an order that was initiated by an August executive order from the Trump Administration. Prior to that, the U.S. Treasury Department extended the original deadline of Nov. 12 to Nov. 27.
While ByteDance negotiated a deal with Walmart, Oracle, and a U.S. investor group to satisfy the government earlier this year, those negotiations appear to be in limbo.
